Terms of Service

1. Overview

Keep Hustlin' ("we", "us", "our") provides a consignment marketplace for sports cards and memorabilia. By creating an account, submitting items, or purchasing merchandise, you agree to these Terms.

2. Consignment Agreement

When you ship items to us for consignment you ("Consigner") retain ownership of the physical card until a sale is completed. You authorize Keep Hustlin' to photograph, vault, list, and sell your items on platforms including eBay and Whatnot.

  • Commissions are calculated on the net remainder after the marketplace's own platform fees, not the gross sale price.
  • eBay: 15% of net remainder on sales under $500; 10% of net remainder on sales of $500 or more.
  • Whatnot: 20% of net remainder (computed using an assumed 11% + $0.30 platform fee unless an actual fee figure is available).
  • Items remain Consigner property until sold; risk of loss in transit to us is the Consigner's until receipt is confirmed at the Vault.

3. Service Tiers & Listing Fees

Two tiers are available at submission time. All listing fees are deferred — Consigner pays $0 upfront and fees are netted from sale proceeds via the ledger.

  • Standard — listed within 5–7 business days. $10 per-card minimum on either platform. $1.00 per-card deferred listing fee. Lots permitted.
  • Express — listed within 2 business days. $25 per-card minimum on either platform. $5.00 per-card deferred listing fee. Maximum 20 cards per submission and one Express submission per consigner per day. Singles only — no lots.

Cards submitted below the per-card minimum for the chosen tier may be returned at the Consigner's expense or, at our discretion, bundled into a single lot listing.

4. Buy-It-Now & Returns

  • Buy-It-Now / Or Best Offer listings are available for cards valued at $1,000 or more. Provide both the BIN price and lowest acceptable offer with the package.
  • Sales under $500 returned without authenticity issues are absorbed by Keep Hustlin' — Consigner keeps the Store Credit.
  • Sales of $500 or more, or items found altered or inauthentic, may be reversed from the Consigner's account (potentially producing a negative balance) and the item returned at Consigner's expense.

5. Prohibited Conduct

Bidding on your own listings ("shill bidding") is strictly prohibited. Violations result in immediate account termination, forfeiture of pending Store Credit, and return of remaining inventory at Consigner's expense.

6. Unsold Items

Cards listed on eBay that do not sell within their auction window are subject to a $2.00 unsold-listing penalty added as a debit on the Consigner's ledger to cover listing cost. The card is then relisted, bundled into a lot, or returned at the Consigner's request (return shipping at Consigner expense). Whatnot has no unsold penalty — unsold cards remain vaulted and re-queued for a future show.

7. Store Credit & Cash-Out

Sale proceeds are credited to the Consigner's Vault account as Store Credit, not as direct bank deposits. Credits become Available and spendable immediately upon the sale clearing. Available Store Credit may be:

  • Spent on Keep Hustlin' merchandise at 100% face value with no withdrawal fee, or
  • Cashed out to the Consigner's bank account via Stripe Connect, subject to a 10% Cash-Out Fee and a $20.00 minimum withdrawal. Stripe Connect onboarding (bank info + identity verification) must be completed before the first cash-out.

Keep Hustlin' reserves the right to reverse Store Credit corresponding to a sale that is later disputed, refunded, charged back, or determined to involve altered/inauthentic merchandise, and to debit the Consigner's account for the reversed amount. Store Credit is a contractual obligation of Keep Hustlin' and is not an FDIC-insured deposit. Vaulted physical cards remain Consigner property at all times.

8. Negative Balances & Debt Pay-Down

If unsold-listing penalties, sale reversals, or other debits cause the Consigner's ledger balance to fall below zero, the Consigner may pay down the balance through a one-time Stripe charge from within the dashboard. New sale proceeds are automatically applied to outstanding debt before becoming spendable Store Credit. Cards remain vaulted while a balance is owed and may not be released until the debt is settled.

9. Merchandise Purchases

Merchandise is fulfilled through Printify. Refunds and exchanges follow Printify's policies. Store Credit may be applied to merchandise purchases at 100% face value. Contact customerservice@keephustlin.com for assistance.

10. Prohibited Items

Counterfeit, stolen, or misrepresented items are strictly prohibited. We reserve the right to refuse any submission and may report fraudulent activity to authorities.

11. Limitation of Liability

To the maximum extent permitted by law, Keep Hustlin's liability for any claim related to a consigned item is limited to the documented fair market value of that item.

12. Changes

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance.
